The closure of the case will contribute the claim in the European court of justice and amendment in the criminal procedure code of the people’s Deputy Lozovoy, he said.

The case of businessman Serhiy Kurchenko has no legal basis and may be closed. This was stated by the lawyer Yury Sukhov, representing interests of the businessman.

“In my opinion, it’s not going to have perspectives, as is being investigated with serious procedural violations. In particular, I mean the pretrial investigation. Today it is already more than 25 months, although the law provides for a maximum period in this case 12 months. From the point of view of the European Convention on human rights is a flagrant violation, which is treated as re-prosecute. Because to achieve lawful decision to cease production is impossible, we have addressed this issue to the European court of human rights, which will seek justice. And given the recently adopted amendments to the criminal procedure code regarding the edits made by the Deputy of Lozovo is a criminal proceeding and is subject to termination,” said he.

Recall, October 3, the Verkhovna Rada in the framework of the judicial reforms adopted bill No. 6232. Amendment 109 MP from the Radical party Andrei Lozovoy provides for amendments to article 219 of the Criminal procedure code of Ukraine regarding shortening of pre-trial investigation. In particular, the period of pre-trial investigation of a grave or especially grave crimes will be limited to six months from the moment of establishing the identity of the suspect pending suspicion. Now the maximum duration of investigation is in special cases 15 years.

Earlier, lawyer Sergei Polishchuk said that the investigation in the case of Kurchenko’s no evidence.

In early October, it was reported that Kurchenko has submitted to Pechersky district court of Kiev the statement of claim to the President of Ukraine Petro Poroshenko and the Ukrainian TV channel 1+1 on the protection of honor, dignity and business reputation.
