The lawyer of the families of the victims of separatists shot down the plane Il-76 of Ukrainian troops Vitaly Pogosyan announced that it has filed a new statement to the Prosecutor General of Ukraine on the officials, who was in command of the ATO, writes Radio Liberty.

It requests to open criminal proceedings under article abuse of power (part 3 of article 365 of the criminal code of Ukraine).

“Based on the analysis of the legislation of Ukraine governing members of the armed forces of Ukraine, which was contracted to carry out anti-terrorist operation security Service of Ukraine, as specified in the respective orders of their appointment, subject to the provisions of law relating to law enforcement officers. Therefore, in this case, the actions of these individuals fall under part 3 of article 365 of the Criminal code of Ukraine”, − said Pogosyan.

The lawyer also said that according to article 214 of the Criminal procedure code, proceedings must be opened within 24 hours.

It is noted that the Prosecutor General’s office has not yet commented on this statement.

Earlier it was reported that the Prosecutor’s office opened, and then closed the criminal case on the fact of abuse of authority by military officials of the armed forces in the period from April to June 2014, when he was hit by Il-76 over Lugansk.

We will remind, on June 14, 2014 LPR separatists shot down a transport plane Il-76 APU coming in for a landing at the airport of Lugansk. All 49 servicemen who were on Board were killed.

Guilty in the incident was recognized as the General-Mayon Viktor Nazarov, who was sentenced to seven years in prison. He admits his guilt in the crash of the aircraft, and filed an appeal.
