International experts concerned with the allegations of interference by state bodies and political forces in the National Commission exercising the state regulation in energy and utilities. About it is spoken in the report on the analysis of the activities of the national Commission prepared by the Energy community Secretariat and the EU, reports RBC-Ukraine.

As noted, the aim of the study was “to assess the extent to which recent criticism NKREKU is the result of it unpopular, but justified market reforms introduced by the regulator or how these reforms are justified, given the quality of the decision-making process”.

The report noted that, according to the interviewed experts, the Council of the national Commission is not always able to act independently. Interviewed stakeholders stated that, while the members of the Commission are appointed by the President, in Ukraine cannot be an independent regulator.

According to information provided by the Secretariat, attempts to influence NKREKU had concrete results.

“August 1, 2017, the national Commission took the Decision № 991, which States “the Method of formation, calculation and establishment of tariffs for electric and/or thermal energy produced at thermal power plants, thermal power plants and installations of cogeneration,” named “formula Rotterdam+”.

According to the new method, the cost of coal production coal-thermal power generation is calculated according to the formula “average cost of coal in the port of Rotterdam over the last twelve months, plus the cost of delivery to Ukraine”.

The national anti-corruption Bureau of Ukraine (NABU) has started an investigation into possible official misconduct by officials of the national Commission, while the decision was made.

Another example of possible intervention in the activities of the Commission, the experts give the decision about establishment of tariffs for services in transportation of natural gas and a new tariff methodology for distribution services for natural gas, adopted on 28 March 2017.

“Decisions led to a slight increase in the total network charges for delivery of gas to end consumers. This aroused strong criticism among politicians. 3 April 2017, the Prime Minister Volodymyr Groysman asked the Chairman of the national Commission to suspend the decision. 4 April 2017 on the news it was reported that the President Petro Poroshenko appealed to the national Commission and asked to suspend this decision to protect consumers. 4 April 2017, the national Commission withdrew its decision on the tariffs for distribution,” reads the report.

Experts of the Energy community the EU believes that the above cases should be considered as an explicit political interference in the independence of the Commission and its Autonomous decision-making.

“It seems that the members of the Commission are under the pressure of certain political and business groups that actually influence the outcome of decisions. However, interviewed stakeholders repeatedly stated that NKREKU, most likely, will not be subjected to political and social pressure, if it can provide the wider public the reasoning for its decisions,” the report says.
