Ukraine and Russia can not agree on the exchange of prisoners

Russian Ombudsman stands for the establishment of a mechanism that would allow countries to extradite convicted citizens of a foreign country.

The Commissioner for human rights of Russia Tatyana Moskalkova also offers find mechanisms for the exchange of prisoners between Russia and Ukraine through the conclusion of special agreements between the countries. She stated at the all-Russian Congress observers on Friday, August 17, reports TASS.

Russian Ombudsman considers that this issue needs to be resolved in legal plane, since the Constitution does not allow to extradite convicted citizens of another state, as the Constitution prohibits the transfer of a convict or not convict a citizen on the territory of another state.

“We need to find mechanisms, perhaps through the institution of pardon, possibly by concluding a special agreement between Ukraine and Russia on the legal status of citizens with two citizenships – Russian and Ukrainian, which would decide the whole complex of problems”, – said the Ombudsman.

In her opinion, such an agreement would solve the issue of consular visits to prisoners, access to prisons commissioners for human rights, and would also give the opportunity to renounce one of the citizenships someone who is in custody, then as now, the law gives no such right.

Earlier, the Ukrainian Ombudsman Lyudmila Denisova said that 22 prisoners in Ukraine, the Russians wrote an appeal to Russian President Vladimir Putin with a request to exchange them for prisoners of Ukrainians.

At the same time, the Ukrainian Director Oleg Sentsov, three months starving in a Russian prison, refuses to write a petition for clemency.
