In Ukraine regularly extend a moratorium on the sale of land

The Prosecutor addressed the court demanding to recognize invalid the land exchange in connection with the moratorium. However, he was denied.

Ukrainian first defended their right to dispose of the land, referring to the decision of the European court of human rights (ECHR).

The case appeared in the court register. On Monday, November 5, according to Opendatabase – service monitoring of registration data of Ukrainian companies and court registry to protect against hostile takeovers and control of contractors.

It is noted that this is the first precedent when, relying on the decision of the ECHR were protected the property rights of Ukrainians in court.

According to court records, the Prosecutor addressed the court demanding to recognize invalid the land exchange in connection with the moratorium. However, he was denied.

“In deciding the case the court referred to the conclusions of the European court of human rights in the case “Zelenchuk and SICURA against Ukraine”, article 14 of the Constitution of Ukraine and norms of civil and land legislation of Ukraine, regulatory arising in the case of the relationship”, – stated in the decision of the court.

We will remind, on may 22 the European court of human rights ruled that the ban in Ukraine on the purchase and sale of agricultural land violates the European Convention on human rights. The government must take legislative measures to repeal the moratorium.

On 2 November it became known that the constitutional court of Ukraine refused to consider the idea of a group of MPs on lifting the ban on the sale of agricultural land.

Also, the media reported that the government has instructed to expedite the lifting of the moratorium on land. Relevant agencies must submit the relevant bill to the Cabinet before year-end.
