Complaints against Ukraine filed a prisoner whose appeal is stuck in the LC.

The European court of human rights handed down the first decision on the complaint against Ukraine, associated with loss of control over Lugansk, reported on the website of the court.

Complaint to the ECtHR was filed by Alexander Chlebik, which from April 2013 is serving a sentence in prison in Luhansk region on charges of several crimes, including banditry and armed robberies.

He soon appealed to the court of Lugansk, but consider it proved impossible after the seizure of power by the separatists.

Chlebik filed a complaint to Strasbourg to Ukraine – he claimed that the state had violated his right to exercise fair justice within a reasonable time period.

The judges of the ECHR unanimously found that Ukraine is not responsible for the consequences of loss of control over the territory of the Luhansk region and did not violate the Convention.

“Having considered the arguments of Kyiv that Ukraine has made every effort to obtain materials of the case provided the plaintiff with the opportunity to meet with the Ombudsman, as well as the arguments that the conduct of a new investigation of charges against Chlebik without access to case materials is not possible”, – decided in court.

This decision was the first in which the ECtHR examined the complaint that is associated with the loss of Ukraine’s control over the territories of Donbass.

Earlier it was reported that Ukraine will no longer file any new lawsuits in the ECHR to Russia about events in Crimea and the Donbass, and to submit applications to the already existing.
