Liquidation of territorial bodies of the Ministry of justice would violate the constitutional rights of Ukrainians to unite, – lutkovskaya

The Ukrainian Parliament Commissioner for human rights Valeria Lutkovska believes that the elimination of territorial bodies of the Ministry of justice of Ukraine, which provides for the resolution of the Cabinet of Ministers No. 99, would violate the constitutional rights of Ukrainians to unite, particularly in public organizations, political parties and trade unions. This is stated in the petition of the Ombudsman to the Prime Minister Vladimir Groysman, reports a press-service Lutkovska.

“Pursuant to paragraph 14 article 1 of the law of Ukraine “On state registration of legal entities, physical persons-entrepreneurs and community groups” solely of rayon, district in cities, city (cities of regional value), gorrayonny, Interdistrict Department of justice empowered the state registration of public associations, their separate subdivisions, public associations without the status of legal entities, local and primary trade unions, their organizations and associations, structural divisions of political parties, regional (local) creative unions, territorial cell of all-Ukrainian creative unions, local employers ‘ organizations and their associations, confirmation of the all-Ukrainian status of public Association. Liquidation of territorial bodies of the Ministry of justice of Ukraine, stipulated by paragraph 1 of resolution No. 99, will result in the violation of constitutional rights of citizens on Association”, – is noted in the statement of the Ombudsman.

According to Lutkovska, the government should amend the Law of Ukraine “On state registration of legal entities, physical persons-entrepreneurs and community groups”, which provide an efficient mechanism for the implementation of the rights of Ukrainian citizens to unite in public organizations, political parties and trade unions.

“Prior to the entry into force of the amendments necessary to take measures concerning prevention of violation of these rights of citizens”, – stated in the appeal of the Ombudsman.

Note, the right to freedom of Association in political parties, public organization and participation in trade unions is guaranteed by article 36 of the Constitution of Ukraine and article 11 of the Convention for the protection of human rights and fundamental freedoms.

Valeria lutkovskaya earlier appealed to the Prime Minister of Ukraine Vladimir Groisman to pay attention to legislative changes, the implementation of which threatens the destruction of the system of accounting of homeless and violation of their civil rights.
