If after 2019 the pipeline will not have traffic, the contract will allow to demand from Gazprom, the compensation costs associated with the economic depreciation of the capital invested.

In case of revision of the tariff for gas transit via Ukraine, Naftogaz will have to claim compensation from Gazprom in the amount of up to $ 15 billion. On Thursday, April 12, according to Ukrainian news.

It is noted that such data are contained in the letter from the Chairman of the Board of Naftogaz of Ukraine Andriy KOBOLEV, the Prime Minister Volodymyr Groysman.

“Even in case of disagreement on a revision of the tariff from Gazprom the right to a review gives you the opportunity to order the arbitration proceedings to seek compensation from Gazprom for payment in 2018 or 2019 at the current rate, which does not fully cover all costs associated with the transit of gas. In addition, in the absence of transit after 2019 tariff allows you to claim compensation for it – in particular, to require the other parties to the contract compensation for costs associated with the economic depreciation of the invested capital, i.e. the lost value of transit assets. According to the company, the right to revision of rate in General may allow the company to receive additional compensation in the amount of up to $ 15 billion,” – said in the letter.

KOBOLEV also said that the dispute over the tariff rate can also be a significant economic incentive for Gazprom to continue the transit after 2019.

It is noted that Naftogaz had already made a submission on the revision of the tariff for gas transit the Ukrainian gas transportation system to Gazprom, that has started a procedure that is required by the contract.

Yesterday it was reported that Naftogaz and Gazprom began to negotiate the terms of gas transit through Ukraine’s territory after 2019.

We will remind, earlier the head of Gazprom Alexei Miller said that his company “has never raised the question of waiver of the Ukrainian transit”.
