The EU court: the Assets of Yanukovych legitimately frozen

The plaintiffs did not provide evidence that would cast doubt on the validity of the charges made against them.

The European court of justice in Luxembourg ruled on the appeal of former Ukrainian President Viktor Yanukovych and his son Alexander on sanctions imposed on them in the EU in 2015-2016.

It is reported by the European true with reference to the registry of the court.

We are talking about the lawsuit of the family of Yanukovych, in which they appealed the decision of the court of justice a year ago. On 15 September the European court of General jurisdiction (General Court) ruled on two waves of sanctions imposed by the EU Council against the former President and his son. Then in Luxembourg, “in retrospect” lifted sanctions, dated 2014, but confirmed the potential of more sanctions, in force after 2015.

Viktor and Alexander Yanukovych appealed last year’s decision in the European court (European Court of Justice), which considers appeals of decisions rendered by the first instantiated the EU.

The Grand chamber of the EU Court fully confirmed the original decision, recognizing the legitimate European sanctions against Yanukovych, freeze assets.

Adopted on 19 October decision of the European court, in particular, specifies that the “fear of Viktor Yanukovych Alexander Viktorovych Yanukovych prejudice to the Ukrainian judicial system may not question the validity of the charges against them in very specific cases of theft of public funds”.

The court also finds that plaintiffs have not provided any evidence which could cast doubt on the validity of the charges made against them in Ukraine.

The decision of the European court concerns only one wave of sanctions, which operated between March 2015 and March 2016, respectively, now expired. However, it suggests that the attempts of Yanukovych’s family to appeal against the next wave of sanctions against them (in particular, imposed in 2016 and 2017) will surely also fail.

As reported Корреспондент.netthe European Commission knew nothing about the assets of Viktor Yanukovych to the EU, which could be frozen by the EU sanctions. This was stated by British lawyers from the company JHA LLP who conduct the Affairs of the family of Yanukovych in the West.

“Yanukovych has always maintained that he had no Bank accounts or other assets in any other country, except for Ukraine”, – added the lawyer.

It was also reported that the EU sanctions have no money or assets of Oleksandr Yanukovych.
