London’s high court was decision in the case of PrivatBank

The judge acknowledged the evidence of a carefully planned fraud and money-laundering in especially large sizes.

The high court in London on Tuesday, 4 December, officially delivered its judgment in the case against PrivatBank Igor Kolomoisky, reported the press service of PrivatBank.

In particular, the judge upheld an arrest order for the worldwide seizure of assets of former owners of the Bank Igor Kolomoisky and Gennady Bogolyubov, and the six associated companies in the amount of 2.6 billion dollars. The defendants are forbidden to dispose of its assets without the Bank’s consent or permission of the English court.

The decision States that the provided Bank evidence points to a carefully planned fraud and money-laundering in especially large sizes by implementing sophisticated artificial schemes involving a large number of loans and advance payments on supply agreements to fulfill that no one was going. (paras 25-26).

At the same time, the judge did not make final conclusions about fraud.

The Bank’s claim concerned fraudulent acts in relation to loans amounting to USD 1.9 billion, but the judge decided that the Bank has sufficient for judicial review of the matter in the amount of 515 million dollars.

Protection Kolomoisky, in turn, pointed to the fact that the judge expressed “serious non-disclosure and misrepresentation,” and acknowledged the error, issued a year ago, the world for the seizure of assets.

The lawyers also said that Privat the judge should compensate legal expenses in the amount of 7.5 million pounds, of which four million pounds has to be paid Kolomoisky within 28 days.

The final decision on jurisdiction will make the court of Appeal of England.
