The question of the transfer Savchenko, according to the norms of the Convention will be decided by the court.

The Russian Ministry of justice received from the Ministry of justice of Ukraine with a request to provide documents necessary for the transfer of Hope Savchenko Kiev for further punishment, reported “Interfax” in the press service of the Russian authorities.

“In the Ministry of justice of the Russian Federation by facsimile the request of the Ministry of justice of Ukraine on granting of the documents necessary for consideration of the issue of transfer of sentenced Savchenko to Ukraine to continue serving their sentence of deprivation of liberty”, – noted in the Ministry of justice of the Russian Federation.

There pointed out that the terms of consideration of requests of the competent authorities of the States parties to the Convention on the transfer of sentenced persons is regulated by international Treaty.

The report said that the question of the transfer of Savchenko after collecting and checking all necessary documents, according to the norms of the Convention will be decided by the court.

“For consideration by the Russian court to rule on the transfer of sentenced Savchenko to Ukraine by the competent authority of that state must be provided to the Russian side consent to its transfer, as well as the order of the Ukrainian court for enforcement in accordance with the legislation of Ukraine of the verdict of the Donetsk town court of the Rostov region from 22.03.2016 in respect of the specified person with the mark of entry into force and translation into Russian language”, – stated in the Ministry of justice.

It stressed that the sentenced person may be transferred under certain conditions, including the entry into force of the verdict, the prisoner’s consent.

“In the transmission entity may be denied in cases if none of the acts for which the person is convicted is not considered a crime under the laws of the state of nationality of the convicted person”, – reported in a press-Department service.
