The Supreme court will challenge the right of the President to form NKREKU

The Supreme court of Ukraine considers that the formation of the National Commission, which performs state regulation in the sphere of energy and utilities (NKREKU) the President of Ukraine contradicts the main law of the country and referred the petition to the constitutional court of Ukraine. This was during the briefing said the Chairman of the Supreme court Yaroslav Romaniuk, reports “Interfax-Ukraine”.

“The Supreme court believes that when we had a presidential-parliamentary Republic, it was assigned to the office of the President, but due to the fact that in February 2014 it was restored the action of the wording of the Constitution, which foresees a parliamentary-presidential Republic, it is not within the powers of the President of Ukraine”, – said the Chairman of the Supreme court.

According to him, in the Supreme court I doubt that those provisions of law that grant such powers to the President correspond to the Constitution as an exhaustive list of the powers of the President should be enshrined in the basic law.

We will remind, on April 12 the Verkhovna Rada of Ukraine (VRU) adopted the revised bill No. 2966-d “On the National Commission exercising the state regulation in the spheres of energy and communal services”. The corresponding decision in the first reading was supported by 285 MPs.

According to the explanatory Memorandum, the purpose of the development of the draft law on the implementation of commitments of Ukraine as a party to the energy community Treaty.
