In the Transparency commented on the abolition of the law of unjust enrichment
The organization believes that the decision of the constitutional court on the abolition of the law on illicit enrichment violates the international obligations of Ukraine.
In Transparency International believe that if Ukraine will not find solutions on the issue of articles of the Criminal code on illicit enrichment, it is likely that the visa-free regime with the EU and IMF financial assistance would be frozen. This is stated in the Transparency statement.
It noted that the decision of the constitutional court to recognize unconstitutional the article of article 368-2 of the criminal code “significantly weakens the country’s efforts to combat corruption.” In the organization also believe that this decision violates the international obligations of Ukraine.
“The court’s decision essentially gives government officials the opportunity to legalize them, perhaps illicitly acquired assets and to not be afraid of criminal prosecution”, – said Andrey Borovik, Executive Director of TI Ukraine.
Transparency does not agree with the argument of the SIC that article 368-2 violated the principle of presumption of innocence.
“Even if introduced and passed a new law on illicit enrichment, it will not be retroactive, all closed now current cases will remain closed, allowing corrupt officials to escape justice,” – said in a statement.
“Officials accused of corruption should be brought to justice, the rule of law must prevail. If a solution is found, it is likely that the visa-free regime with the EU and IMF financial assistance would be frozen, which will prevent the country’s economic development,” said Delia Ferreira Rubio, chair of Transparency International.
We will remind, on the eve of the KSU issued a decision to cancel the article of the Criminal code on illicit enrichment. Human rights activists noted that the CCU decision will mean a complete Amnesty for all officials with questionable income.
Petro Poroshenko has said that he would bring to Parliament a bill on the punishment for illegal enrichment after the promulgation of the decision of the constitutional court on recognition of the relevant article of the criminal code unconstitutional.
