The appellate court withdrew the arrest of 23 non-residential premises, 5 apartments, garage, pharmacy, 2 land of Anatoly Fedoruk.

The Kyiv court of appeals released 23 non-residential premises, 5 flats, 2 plots, pharmacies and funds seized from the mayor of Kiev region Bucha Anatoly Fedoruk. This is stated in the materials of the court, transmit Ukrainian news.

It is noted that all the property of the mayor was arrested by the decision of Pechersk district court of Kyiv on July 26. Fedoruk’s wife Lyudmila Ivanovna, the mayor and their lawyer has filed an appeal against this decision on 22 August and 4 October the court of Appeal dismissed the appeal.

Thus, the Appellate court reversed the trial court’s decision and withdrew the arrest from the entire property.

According to the panel of judges of the court, the Prosecutor could not in the absence of a civil action to seek arrest of the suspect for the purpose of compensation of the caused damage.

“The seizure with the aim of ensuring a civil lawsuit that will be filed in the future, makes it impossible to clarify the question of proportionality property on which the Prosecutor requested to seize and claim as he has not lodged by the person concerned”, – stated in the judgment.

Thus, the Appellate court withdrew the arrest of 23 non-residential premises, 5 apartments, garage, pharmacy, 2 land.

Also canceled the arrest of the funds received: 29 749 UAH, 5929 dollars, 150 euros, 1040 PLN, 4000 HUF, 55 060 rubles.

As reported Корреспондент.netin the summer of 2016 in city Council Buchi were searched, which resulted in October the mayor of the city Anatoly Fedoruk was removed from office by the decision of the Pechersk district court.

However, in November the head of the city Bucha returned to his office. The Kyiv appeal court satisfied the appeal of protection of Anatoly Fedoruk and cancelled the decision of Pechersky court.
